TERMS AND CONDITIONS

These Terms and Conditions govern the services provided by iClean Dry Cleaners (“the Company”) to its customers. By using our services, you agree to be bound by these Terms and Conditions. These Terms supersede all previous versions. Any customer terms not contained here are expressly excluded.

1. DEFINITIONS

Business Day – Any day other than Saturday, Sunday, or public holiday in Western Australia.
Company – iClean Dry Cleaners (ABN 37 162 732 582).
Customer – The individual or entity entering into a contract for services with iClean Dry Cleaners.
Party/Parties – Refers to either or both the Customer and the Company.
Relevant Law – Applicable legislation, regulations, or codes governing this agreement or services.
Services – Dry cleaning, laundering, alterations, repairs, and other related services.

2. INTERPRETATION

Standard interpretation rules apply. All references to monetary values are in AUD. Time and date references are to Perth time.

3. BASIS OF AGREEMENT

3.1 The Customer engages iClean for Services in accordance with these Terms.
3.2 Any variations must be in writing and signed.
3.3 No exclusivity is granted unless otherwise stated.

4. CARE FOR GARMENTS

4.1 We follow all care labels and inspect for damage before processing.
4.2 If alternate treatment is required, your written approval will be sought.
4.3 Garments without care labels are cleaned at your own risk.

5. COLLECTION OF GARMENTS

5.1 We strive for timely service but are not liable for unforeseen delays.
5.2 Items uncollected after 90 days may be disposed of.
5.3 The Company is not liable for any resulting loss.

6. PERSONAL ITEMS

6.1 Customers must ensure garments are free of valuables.
6.2 Found items will be stored for 30 days.
6.3 We are not liable for loss or damage caused by items left in garments.

7. LOSS OF GARMENTS

7.1 Claims must be made within 24 hours of collection to enable investigation.

8. PAYMENTS

8.1 All prices include GST unless otherwise stated.
8.2 Invoices are issued within 5 Business Days.
8.3 Payment terms:
(a) Commercial customers – 14 days from invoice date.
(b) Individual customers – Payment due on collection.
8.4 Late payments incur 5% interest above WA pre-judgment rate, calculated daily.
8.5 Customers are liable for all costs related to recovery of overdue accounts.

9. COMMERCIAL CREDIT CUSTOMERS

9.1 Credit terms only apply to approved clients.
9.2 Credit limits are reviewed periodically.
9.3 Director guarantees may be required.
9.4 All terms under clause 8.5 apply.

10. GOODS AND SERVICES TAX

10.1 GST is included unless stated otherwise.
10.2 Valid tax invoices are issued for taxable supplies.
10.3 Both parties must be registered for GST.

11. DAMAGE

11.1 The Company exercises the utmost care in cleaning and processing garments and uses processes which, in our professional opinion, are best suited to the nature and condition of each item. However, we cannot be held responsible for inherent weaknesses or defects in materials, fabrics, trims, or attachments.

11.2 The Company does not guarantee against:

  • Colour loss, colour bleeding, or shrinkage;

  • Damage to weak or tender fabrics;

  • Damage from beads, sequins, bonded fabrics, zips, buttons (including cracked or broken buttons), metal attachments, trims, leather/suede elements, or other embellishments;

  • Damage caused by foreign objects left in pockets.

11.3 Buttons, zips, and other fasteners may crack, loosen, or break during cleaning. While we make every effort to prevent this, such damage is often due to manufacturer defects, age, or stress points and is therefore beyond our control. Cracked or broken buttons during the dry-cleaning process will not be covered by the Company unless gross negligence can be demonstrated.

11.4 The Company inspects each item before return to ensure it meets our quality standards. Any overlooked stains may be re-treated provided the item has not been worn and is returned within 24 hours.

11.5 Stain removal will be attempted carefully. If further treatment is likely to damage the garment, cleaning will cease.

12. DISPUTE RESOLUTION

12.1 Claims must be submitted within 24 hours of collection.
12.2 Disputes will first be handled through good-faith negotiation.
12.3 Valid claims require an invoice or receipt.
12.4 If unresolved, disputes may be referred to the Fair Claims Guide for Consumer Textile Products.
12.5 Parties agree to be bound by this guide.

13. INSURANCE

13.1 iClean maintains appropriate insurance while services are being provided.

​

14. LIMITATION OF LIABILITY

14.1 iClean limits its liability to:
(a) Resupplying the affected service; or
(b) Reimbursing the cost of the service.
14.2 Maximum liability for damage caused by the Company is 10x the cleaning fee for the garment, in line with the Fair Claims Guide.

15. PRIVACY

15.1 We comply with the Privacy Act 1988 (Cth).
15.2 Customer data is only used to provide services and will not be sold or disclosed without consent, except as required by law.

16. GENERAL

16.1 Multiple customers are jointly and severally liable.
16.2 Terms apply to heirs, successors, and assigns.
16.3 Governed by WA law; WA courts have jurisdiction.
16.4 Terms may be updated with notice.
16.5 If any clause is found unenforceable, it will be severed.
16.6 Headings are for convenience only.
16.7 Non-enforcement of any clause does not constitute a waiver.

17. SPECIALTY ITEMS & RISK ACKNOWLEDGMENTS
Certain items (e.g., curtains, wedding gowns, leather, imitation suede, or garments without care labels) carry higher risks during cleaning. Customers may be required to sign a specific declaration form acknowledging those risks before cleaning proceeds. These declaration forms form part of our service conditions and are available at point-of-service or on our website.
